SITEFY USER AGREEMENT (TERMS OF USE)

This User Agreement (“Agreement” or “Terms”) governs your access to and use of the website, products, and services operated by Sitefy Global Technologies Pvt. Ltd. (“Sitefy”, “we”, “us”, or “our”), accessible at https://sitefy.in (collectively, the “Services”).

By accessing or using our Services, you agree to be bound by this Agreement.

1. ACCEPTANCE OF TERMS

• By using our Services, you confirm that you have read, understood, and agree to these Terms.

• These Terms take effect upon your first use of the Services.

• Continued use constitutes ongoing acceptance of any updates.

• If you do not agree, you must immediately stop using the Services.

2. ELIGIBILITY

To use our Services, you must:

• Be at least 18 years old

• Have legal capacity to enter into binding contracts

• Provide accurate and complete information

3. SERVICES OFFERED

Sitefy provides, but is not limited to, the following services:

• Web & Website Development

• Mobile & App Development

• Software & SaaS Development

• IT & Technical Services

• SEO & Digital Marketing

• Content Writing Services

• Lead Generation Services

• Resource & Staff Augmentation

• Support & Maintenance

• AI, Automation & Data Analytics

• Virtual Assistant Services

Service scope, pricing, and timelines may be governed by separate written agreements.

4. ACCOUNT REGISTRATION & SECURITY

Registration Requirements

You agree to:

• Provide accurate, current information

• Maintain confidentiality of login credentials

• Notify us of unauthorized access

Account Responsibility

You are responsible for all activities conducted through your account.

Password Policy

Passwords must:

• Be at least 8 characters

• Include upper & lowercase letters

• Include numbers and special characters

We recommend enabling multi-factor authentication.

5. ACCEPTABLE USE

You agree to use our Services lawfully and not to:

• Resell or redistribute services without permission

• Reverse-engineer or exploit the platform

• Upload malware, spam, or harmful code

• Infringe intellectual property rights

• Harass, threaten, or impersonate others

• Engage in phishing or data scraping

• Use automated tools without authorization

Violation may result in suspension or termination.

6. CONTENT & DOMAIN RESPONSIBILITY

• Domains purchased by Sitefy on behalf of clients remain the sole property of the client

• You are solely responsible for:

  • Content legality

  • Copyright & trademark compliance

  • Accuracy of published material

User Content

• You retain ownership of your content

• You grant Sitefy a non-exclusive, royalty-free, worldwide license to use content solely to provide services

• You are responsible for content backups

• Sitefy is not liable for data or content loss

Prohibited content includes malware, illegal material, spam, and content harmful to minors.

7. MONITORING & ENFORCEMENT

We may monitor usage to:

• Ensure compliance

• Prevent abuse or fraud

• Protect systems and IP

Monitoring may include logs, automated tools, and manual reviews. We are not obligated to monitor but reserve the right to do so.

8. INTELLECTUAL PROPERTY

All Sitefy trademarks, software, designs, and materials are the exclusive property of Sitefy unless otherwise stated. No rights are granted except as expressly provided.

9. PAYMENTS & FEES

• Fees are payable as agreed and are non-refundable unless explicitly stated

• You authorize charges to your chosen payment method

• You are responsible for applicable taxes

• Disputes must be raised promptly

Payment processors’ terms may apply.

10. TERMINATION

By Sitefy

We may suspend or terminate access for:

• Breach of Terms

• Non-payment

• Illegal or prohibited activities

• Misrepresentation

By You

You may terminate by:

• Providing written notice

• Paying outstanding dues

• Ceasing service usage

Upon termination, access ends and data may be deleted.

11. WARRANTIES & DISCLAIMERS

• Services are provided “as is”

• No warranties of uninterrupted or error-free service

• Sitefy disclaims all implied warranties to the maximum extent permitted by law

12. LIMITATION OF LIABILITY

To the fullest extent permitted by law:

• Sitefy shall not be liable for indirect, incidental, or consequential damages

• Total liability shall not exceed fees paid in the preceding 6 months (if applicable)

13. INDEMNIFICATION

You agree to indemnify and hold harmless Sitefy from claims arising out of:

• Your use of Services

• Violation of laws

• Content you provide

• Breach of these Terms

14. DISPUTE RESOLUTION

Arbitration

All disputes shall be resolved through binding arbitration under the Arbitration and Conciliation Act, 1996.

• Sole arbitrator appointed by Indian Council of Arbitration

• Seat & Venue: Kolkata, West Bengal

• Language: English

• Costs: Shared equally

No class actions permitted.

15. GOVERNING LAW & JURISDICTION

This Agreement shall be governed by the laws of India. Courts at Kolkata, West Bengal shall have jurisdiction where arbitration is not applicable.

16. MODIFICATIONS

• We may update these Terms at any time

• Material changes will be notified

• Continued use after changes constitutes acceptance

17. FORCE MAJEURE

We are not liable for delays or failures caused by events beyond reasonable control.

18. SEVERABILITY

If any provision is held invalid, remaining provisions remain in full force.

19. ENTIRE AGREEMENT

These Terms constitute the complete agreement and supersede all prior agreements.
